Council Tax Arrears
Council taxes are the specific types of payment, which should be considered priority debts, therefore must be placed on the top of every household outgoings. Council tax is a method of gathering taxation according to the value of one’s property. Although some properties are defined tax free, and some owners can get reductions (properties which serve social assistance purposes), the majority of people have the legal obligation to pay the council tax.

Council tax arrears are almost always stemming from a financial difficulty. If the payment deadline is over, and you have not made the payment, a written notification can be expected, which reminds you that council tax arrears are to be sent within seven working days. Should council tax not be paid within the next week, the court can issue a liability order against you. The result of this is that taxes are collected directly from your incomes and other state benefits. In the most extreme cases you can end up in the prison for non-payment.
The most important question which arises in this situation is why and how the council tax arrears have occurred? In many cases financial difficulties appear unexpectedly, almost always involuntarily. In case of unemployment, old age, or any type of disablement, check out if the laws make it possible to have some reductions and other benefits. You should also apply for a discount from the local authority if, for example, your family has a low total income. If you are struggling with other debts try to draw up a debt management plan, which will help you to clear your financial situation through reducing monthly expenditure, and thus will create funds to re-pay your tax arrears.
The local authority’s measures against you in case of council tax arrears are the following:

the consequences of the liability orders can be the decision, according to which your arrears will be recovered through deductions from your incomes
in the most serious case a bailiff is launched, which means that goods can be taken from your home, and sold later to clear the debt.
they can legally make you bankrupt
they can also issue a charging order, which means that they can force you to sell your house in order to pay off your debts
in extremely rare cases the local authority can make you to become committed to prison, if you willfully refuse or neglect to pay the taxes.

What to do if you can’t pay the council taxes?

the first and most obvious step is to contact your local authority. Explain your situation clearly, and offer a solution (usually this means the proposal to pay regularly amounts that you can afford)
try to apply for a council tax benefit. This is especially important if you and your family live on low monthly incomes or if you can prove that you are temporarily unable to work due to some illness. In this way you can agree upon a longer repayment period. However, in this case backdating is generally not allowed.
If you have a disability or you live with and care for someone with disability you may also apply for the so called disability reduction. In addition, you have to know that disability reductions can be backdated.
set up a monthly budget plan in which you define the debt priorities, and try to stick to it. Place council tax arrears on the top of your payment obligations.
if you struggle with severe hardships (either financial or personal) ask for advice. It is always a good solution to contact your local councillor. Your local councillor can offer considerable help and support while dealing with the local authority.

What if you can’t avoid the ultimate steps?

If the situation ends up in the last stage of your local authority collecting the arrears owed, a bailiff committee can come to your house. In this case, it is always better not to let them in, since once they’ve entered they have the right to seize your goods. Do not sign any papers and contracts that you are unsure about or the contents of which you do not understand. You should also know that the bailiff’s visit is very expensive, and these costs will also be added to your debts. Since you receive a notification of the bailiff’s visit two weeks earlier, you attempt to prevent it is always a sympathetic gesture in the eyes of the local authority. Offer to come to an agreement on paying your debts as soon as possible. Thus, you can postpone any further, severe court measures.

And last but not least: do not hesitate to ask for help. There are many organizations/agencies which offer support, guidance, and valuable advice free of charge.
